End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you and ForzaCloudTech LLC ("Licensor") for the Forza Assistant mobile application ("Software"). By downloading, installing, or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.

1. License Grant

Subject to your compliance with this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, solely for your personal, non-commercial use, as permitted by the applicable app store terms.

2. License Restrictions

You may not:

• Copy, modify, or distribute the Software except as expressly permitted
• Reverse engineer, decompile, or disassemble the Software, except to the extent such restriction is prohibited by law
• Modify, adapt, or create derivative works of the Software
• Rent, lease, lend, sell, sublicense, or transfer the Software to any third party
• Remove or alter any proprietary notices on the Software
• Use the Software to violate any law or third-party right

3. Ownership

The Software and all copies, features, and intellectual property rights therein remain the exclusive property of ForzaCloudTech LLC and its licensors. This Agreement does not grant you any ownership interest in the Software.

4. Updates

Licensor may provide updates, patches, or new versions. Updates may be required for continued use. This Agreement applies to all updates unless accompanied by a separate license.

5. Subscription Features

Certain features require a paid subscription. Subscriptions are billed through Google Play or the Apple App Store and are subject to that store's payment and refund policies. Licensor does not process refunds directly.

6. Privacy

Use of the Software is also governed by our Privacy Policy, which is incorporated by reference.

7. Medical Disclaimer

Any medical or health-related features are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider.

8. Termination

This license terminates automatically if you breach this Agreement. You may terminate by uninstalling the Software. Upon termination you must cease all use and delete all copies.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORZACLOUDTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM YOUR USE OF THE SOFTWARE.

11. Governing Law

This Agreement is governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.
